For it to be rape, the fetus has to be alive. And that is what causes the debate here.

Although people say that the fetus is not dead or lifeless, it is not in a state of action and nor is it full of energy or spirit. So, is this really rape/molestation? If the mother experiences a miscarriage, will she be able to file a lawsuit?
