I'm saying that I got a script from another source and sells it? An example is a open source script which is available for free. Person1 modifies it and placed additional features of the free script. If the developer is so keen about opensource projects and care for his dedication to society,then he'll try his best to sue you and ofcourse a lot of people will help him since its opensource.

You should write one yourself. People who write opensource scripts do not want users to profit off them. At least respect that. Write your own.

Guys above it think you misunderstood what I said, I said that 1 guy modifies an opensource project and he sells his modified script, but I got the script and I'm planning to sell it.

You should take care of the reselling rights by the seller and you are safe!
As far as i believe, the script modifier will only get sued for selling opensource script.
You can only get sued in the case where you are selling modified script without permission from its developer
