Create a dispute for non receive of the phone. That way the money will be locked. If you don't do this I can guarantee after 2-4 weeks once you win paypal will tell there is no money inside the sellers account and they can't refund you. So lock the money first by selecting you didn't receive the product.

Open a paypal dispute asap. Every second counts.
