Don't host in Germany! :O
This might've been posted already, but I didn't find any topic with similar names.
Anyway, my friend just had to close his pre-db site due to a claim by the (German) hosting company. They said that "owning sites that index releasenames are illegal in Germany". It's a very stupid claim, as even Google is illegal in that case too with their new search-suggestion function.
Just a warning to everybody, don't host pre-db's or even warez sites there. German law is apparently very strict... and stupid (sry to any Germans).SceneInfo Reviewed by SceneInfo on . German people can get problems if they dont have a site notice with their full name, adress and their phone number (EXAMPLE)!!
Servers with Warez etc can confiscated or just switched off!!
German is crappy for things like warez!!

Oh, here we go again. There is no country that is ok with warez. You can have a warez forum in Germany too. But you need to respect the law by removing the links. If you have some time, and if you live in Germany. Go to some of the Datacenters, and ask them would it be possible that they allow you to have a forum with links from: RapidShare,MegaUpload,FileServe,HotFile, and other file hosts. But, upon request from some of the organizations to remove them from the Website. That would be perfectly fine with everyone.
Follow the law, remove the links. You'll be fine in every country. There is no shit 'offshore' or 'onshore'.

You can even host a warez forum on a US server, but using a legit copy of the script your using.
Many Rapidleech & TF & RDA used for Uploading/Downloading are based in US.
So its highly illegal to host warez file in the US, but they remove it as soon as the job of ul/dl is over.
So the point is, you can run a warez site (by that I mean indexing) in any countryJust obey the DMCA you get and take appropriate measures

So you have to pay some hundred or thousands of euros and have to sign that you wont support the spreading of warez!!

That's just not true. I knew the Administrator of the DDL-Warez.org, and it was hosted there, in Germany in the past. And the Administrator is from Germany. Now It's somewhere in Africa, but the point is. They respect the law, and remove the links that should be removed. If you're from Germany and host it in the Germany, of course you wouldn't buy the domain name, and server under your name. Hell, it's not smart at all to buy anything under your real name if you own something that could bring you problems. Because it could bring you in the same situation that PirateBay owners are dealing with.
Anyhow, the point is. If you respect the law, and remove the links. They can't sue you. DMCA and other copyright organizations are asking you to remove the links, if you don't remove the links. Then they would contact Datacenter, and of course they will nullroute the IP of the server. And ask you nicely to remove the content, if you don't remove the content your server gets suspended. Simple as that.
