If they still insist on providing 99.99% then just ask them to send you an official document in which their CEO has signed that he can provide you 99.99% uptime, else GTFO ! So, its like, if the prices are cheap, you'll get cheap service. But, there is an exception to this. If they have been in business from many years, then hell yeah, they have profited out much to downgrade their market and sell cheap services. If you really want great uptime, then just host your websites on your PC. Its the best, safest & cost effective method. Then, even if something happens, then its you who is responsible.
