    This proves you have no knowledge or a clue about the working of judicial proceedings.

    EA or Microsoft will never ask a filehost to remove a user's account, because simply they don't have the right to do so.

    They can only go to an ISP, ask who the offender is and then prosecute this user directly.

    Copyright owners (or their representatives) have only the right to make a DMCA notice to the host.

    So lets say EA or Microsoft told fileserve to delete the user's account or they will be taken to court.

    hm... Last time i checked EA and Microsoft held copyright to shitload of things, so they dont have the right to complain when we pirate say Gears of War or Microsoft Windows Xp?

    If that wasn't the case, why was i shown a DMCA letter from Microsoft when i shared Gears of War.


    lol, anyway, lets assume here that microsoft and EA dont own the copyright of any software( lol again) , what happens when an actual copyright holder complains to fileserve and asks for account deletion? What should be their response?

    well if that's the case, then fileserve should've only deleted all of the uploader's files
    there's no need to disable the whole account for that reason.. unless fileserve did get irritated by the uploader who somehow managed to snatch $140 per week at their expense lol

    Come to think of it, how did the Germans fine Rapidshare 34 milliion Euros for copyright infringement if the best copyright holders can do is file a DMCA letter? http://mashable.com/2009/06/24/rapidshare-34-million/

    Both Sniffdog and Cloudshadow are right. I think it all depends on which country the filehost is in. Germans may think filehosts are obligated to enforce copyrighted materials while the U.S. law, for examplem may say otherwise. Chinese law may say, "Go ahead, make my day!"

    If i as a copyright holder tell fileserve to remove the account of a person who has uploaded copyrighted material and if fileserve doesn't comply with my request i will sue them for a couple of million dollars.

    What should fileserve do? I dont care about anything else, please tell me, what should be fileserve's response to this situation?

    Yeah, it's kinda useless, because I have never said that. What I said is that a copyright owner cannot demand from a filehost to delete a user's account or take action against a particular user. They can ONLY demand the removal of the file(s) in question.

    How can Microsoft know who uploaded the file?

    Period.
